CS FOR HOUSE BILL NO. 26(JUD) "An Act amending Rule 15, Alaska Rules of Criminal Procedure, relating to depositions." SENATE BILL NO. 16 "An Act relating to the University of Alaska and university land, authorizing the University of Alaska to select additional state public domain land, and defining net income from the University of Alaska's endowment trust fund as 'university receipts' subject to prior legislative appropriation." SENATE BILL NO. 46 "An Act revising the provision of law under which a minor may be charged, prosecuted, and sentenced as an adult in the district court, and adding to the list of offenses for which a minor may be prosecuted as an adult in the district court." WITNESS REGISTER Joe Ambrose, Staff to Senator Robin Taylor State Capitol Juneau, AK 99801-1182 POSITION STATEMENT: Offered information on CSSB 46(RLS) ACTION NARRATIVE TAPE 95-5, SIDE A CHAIRMAN MILLER called the Senate Rules Committee meeting to order at 12:20 p.m. CHAIRMAN MILLER brought CSHCR 9(TRA) (SCHOOL BUS DRIVER APPRECIATION DAY) before the committee. There being no discussion, he asked for the will of the committee. SENATOR SHARP moved and asked unanimous consent that CSHCR 9(TRA) be approved for calendaring. Hearing no objection, it was so ordered. CHAIRMAN MILLER brought CSHB 26(JUD) (DEPOSITIONS IN CRIMINAL CASES) before the committee. There being no discussion, he asked for the will of the committee. SENATOR SHARP moved and asked unanimous consent that CSHB 26(JUD) be approved for calendaring. Hearing no objection, it was so ordered. CHAIRMAN MILLER brought SB 16 (INCREASE LAND GRANT TO UNIV. OF ALASKA) before the committee. SENATOR SHARP moved and asked unanimous consent that SB 16 be approved for calendaring. Hearing no objection, it was so ordered. CHAIRMAN MILLER opened the hearing on SB 46 (PROSECUTE JUVENILE AS ADULT IN DIST. CT.). JOE AMBROSE, staff to Senator Robin Taylor who is prime sponsor of SB 46, stated Senator Taylor was asking that the committee consider a proposed Rules CS. The following language was added on page 2, line 27 - 30 to clear up intent of a provision added in the Senate Finance Committee: " however, unless there is lawful reason for further detention, a person who is under the age of 18 and who has been arrested for violating AS 04.16.050 shall be cited for the offense and released to the person's parent, guardian, or legal custodian." Mr. Ambrose explained that the Finance Committee added "minor consuming" to the list of reasons why an officer can make a warrantless arrest. Senator Taylor wants to be sure that this intent is not punitive, that it is protective. If a minor is arrested for minor consuming without a warrant the job of the police is to cite that individual and then get the individual into the care of a responsible adult. SENATOR SALO moved that CSSB 46(RLS) be adopted. Hearing no objection, the Chairman stated the committee substitute was adopted. SENATOR SHARP moved and asked unanimous consent that SB 46 be approved for calendaring. Hearing no objection, it was so ordered. There being no further business to come before the committee, the meeting was adjourned at 12:29 p.m.
